Terms and Conditions

§1 General provisions

1. These Regulations apply to contracts concluded via the Shop for the Cause available at: sklep.dlasprawy.org, which is run by the Shop Owner. The Regulations define in particular the rules for placing orders and delivering the Goods, the Customer’s rights related to the purchased Goods (including the right to withdraw from the sales contract) and the rules and procedure for considering complaints.

2. The customer using the Shop for the Cause is obliged to:

a) use the Shop for the Cause in a manner consistent with applicable law and the provisions of these Regulations,

b) use the Shop for the Cause in accordance with good practice and respect for the legal rights of other entities, including in particular copyrights and the right to protect the image,

c) use the Shop for the Cause in a way that does not interfere with its functioning,

§ 2 Definitions

Whenever the following terms are used in these Regulations, they should be understood as:

1) Shop owner – NOMADA Association for Multicultural Society Integration, Address: Wrocław, 50-247, street: Paulińska 4/8, entered in the register of associations, other social and professional organizations, foundations and independent public health care institutions of the National Court Register under the number : 0000342030, NIP: 8982168187, REGON: 021136714,

2) Shop for the Cause – a store run as part of the internet platform, available at: sklep.dlasprawy.org

3) Customer – a natural or legal person or other entity with limited legal capacity that uses the Online Shop;

4) Consumer – means a natural person who performs a legal transaction with the entrepreneur not related directly to his business or professional activity.

  1. Goods – mean the items offered by the Shop Owner or another entity for retail sale available in the Shop for the Cause

  2. 6) Price – it ought to be understood as the gross price of the Goods next to the information about the Goods, not taking into account the costs of delivering the Goods. The prices of the Goods in the “Shop for the Cause” are expressed in Polish zlotys and include VAT;

  3. 7) Supplier – it is understood as a courier company cooperating with the Store Owner.

  4. 8) Order – it means an order for Goods or Goods placed by the Customer in the Shop for the Cause in accordance with these Regulations.

  5. 9) Delivery – means the actual act of delivering the Goods specified in the order to the Customer by the store owner or the Artist via the Supplier.

  6. 10) Artist – a third party who is the creator and owner of the Goods offered under the “Buy Art” section, represented in this transaction by the Store Owner.

§ 3 Customer and Customer Account

1. The client may be a person with full legal capacity or a person with limited legal capacity and having the consent of his legal representative.

2. The Customer may place Orders using a previously registered Customer Account or without registration.

3. In order to create a Customer Account, the Customer is obliged to register free of charge in the Shop for the Cause.

4. The status of a registered user of the Shop is obtained after performing the following steps:

a) correctly completing the registration form on the Shop’s website (in particular, providing the personal data required in the form and establishing a login and password by the Customer),

b) activating the account by entering the link sent to the Customer’s e-mail address.

5. Registration activities are performed once. With each subsequent Order, the Customer uses the login and password previously set on the Shop’s website. After using the login and password set by the Customer, he has the option to update the data provided during registration. Login and password are confidential.

6. After sending the completed registration form, the Customer shall immediately receive, to the e-mail address provided in the registration form, the Registration confirmation by the store owner. At this moment, an agreement is concluded for the electronic provision of the Customer Account service, and the Customer gains the ability to access the Customer Account and make changes to the data provided during Registration.

7. In the event of loss of access to the Customer Account or access to it by unauthorized persons, the Customer is obliged to immediately report this fact to the Shop Owner.

§4 Shop for the Cause

1. Shop for the Cause is an internet platform and a brand run by the Shop Owner as part of its business activities.

2. There are two separate types of sales within the Shop for the Cause: “Products” and “Buy a piece”.

3. The “Products” section covers the sale of Goods which are the property of the Shop Owner, for the quality, defects and delivery of which he is directly responsible.

4. The “Buy Art” section covers the sale of Goods owned by artists who put their creations on sale in the “Shop for the Cause”. In the case of sales contracts concluded as part of this department, the Shop Owner is an intermediary between the Artist and the Customer, and the Seller is the Artist within the meaning of civil law.

5. In the case of contracts concluded under the “Buy Art” section, the Artist is the person responsible for the quality, defects and delivery of the Goods. All claims related to this can also be directed to the Artist via the Shop Owner.

6. Within the “Buy Art” section, each product is provided with the name and surname of the Artist from whom it comes. After placing the order by the Customer, the Shop Owner, in the e-mail confirming the order, will provide the Customer with the contact details of the Artist with whom the contract was concluded, and the Artist with the customer’s address details in order to complete the Order and Delivery.

7. Profits obtained by the Shop Owner as part of the Shop for Cases activities are allocated to the statutory activities of the Shop Owner. In the case of the “Buy Art” section, the Artist transfers the individually agreed part of the Price obtained to the Shop Owner on the basis of a separate agreement.;

6) Price – it ought to be understood as the gross price of the Goods placed next to the information about the Goods, not taking into account the costs of delivering the Goods. The prices of the Goods in the “Shop for the Cause” are expressed in Polish zlotys and include VAT;

7) Supplier – it is understood as a courier company cooperating with the Store Owner.

8) Order – it means an order for Goods or Goods placed by the Customer in the Shop for the Cause in accordance with these Regulations.

9) Delivery – means the actual act of delivering the Goods specified in the order to the Customer by the store owner or the Artist via the Supplier.

  1. Artist – a third party who is the creator and owner of the Goods offered under the “Buy Art” section, represented in this transaction by the Shop Owner.

§ 5. Placing orders

1. The Customer may purchase the Goods in the Shop for the Cause assortment by placing an order. Orders may be placed 24 hours a day, seven days a week via the website of the Shop for the Cause www.sklep.dlasprawy.org.

 

2. An indispensable element of the ordering procedure is that the Customer reads and accepts these Regulations, which the Customer confirms by checking the appropriate box before finalizing the order. The lack of acceptance of the Regulations by the Customer makes it impossible to use the possibility of purchasing the goods through the Shop for the Cause.

3. Customers entitled to place Orders for Goods are the following Customers:

a) having the status of a registered user of the Shop for the Cause,

b) not having the status of a registered user of the Shop – making purchases without registering and logging in.

4. A customer with the status of a registered user of the Store places an order after logging in to the Shop by adding the Goods presented in the Store to the Cart, then confirming the order for the Goods by selecting the button – “Confirm order”.

5. A customer who does not have the status of a registered user of the Store places an order by adding the Goods presented in the “Store for Matters” to the Cart, then confirming the order for the Goods by selecting the button – “Confirm order” and providing the data necessary to complete the order in accordance with the procedure on Store’s website.

6. After placing the Order, the Customer receives an e-mail with a summary of the order and information about the registration of the Order in the Shop.

§ 6 Prices

1. The prices of the Goods presented on the website of the “Shop for the cause” are expressed in Polish zlotys and are gross prices, ie they include taxes, including value added tax (VAT).

2. The prices of the Goods provided on the website of the “Shop for the cause” do not include the costs of delivery. The costs of delivering the ordered Goods are each time provided on the website of the “Shop for the cause” when placing the order, including directly before and at the time of approval and submission of the order by the Customer, and are included in the total value of the order. The total value of the order includes the price of the Goods and the costs of its delivery.

3. Information on the price of the Goods, features and essential properties of the Goods are available on the website of the “Shop for the cause” and are placed next to the presented Goods.

4. The binding and final price is the price given in the “Basket” in the order summary at the time of placing the order by the Customer via the “Shop for the cause”.

5. The prices of the Goods given on the websites of the “Shop for the cause” are valid only when placing orders via the “Shop for the cause”.

6. The prices of the Goods presented on the website of the “Shop for the Cause” may change, and the change in the price of the Goods does not affect orders placed before the price change comes into force.

§ 7 Payment methods and terms

1. The owner of the store provides the customer with the following methods of payment of the price under the concluded sales contract:

a) online transfer to the shop owner’s bank account kept at the bank: mBank, under the number: 07114011400000469018001013

b) cash payment on delivery, only when choosing the method of delivery by courier,

c) electronic payments via Przelewy24.pl.

2.Payment term:

a) If the Customer selects payment by bank transfer or electronic payment, the Customer is obliged to make the payment within 7 calendar days from the date of placing the Order,

b) If the Customer chooses to pay in cash on delivery, the Customer is obliged to make the payment upon delivery.

3. The moment of payment is the moment when funds are credited to the shop owner’s bank account in the case of payment by bank transfer or credit card, or a positive result of payment authorization by the services mentioned in par. 1) lit. c).

4. The owner of the store may individually agree with the customer on other, specific terms and forms of payment. In this case, the terms and forms of payment indicated in the agreed by both parties and confirmed by the Store Owner in an e-mail apply.

  1. The shop owner, in order to simplify the sales process, is also entitled to collect the selling price due to the Artist.

§ 8 Delivery methods and order fulfillment dates

1. The delivery of the Goods is available on the territory of the Republic of Poland.

2. The delivery of the Goods to the Customer is payable, unless the Sales Agreement provides otherwise. The costs of delivery of the Goods (including charges for transport, delivery and postal services) are indicated to the Customer when placing the Order.

3. Goods ordered in the “Shop for the Cause” are delivered through the Supplier. In the case of Goods sold under the “Products” section, it is possible to collect them in person at the premises of the Store Owner.

4. Possible conditions of shipping outside the country, the shipping cost is each time determined individually for each Order, depending on the destination country, weight and size of the shipment. It is not possible to ship abroad with cash on delivery.

5. The order fulfillment time includes the time needed to complete the ordered goods and prepare it for shipment, plus the delivery time. This time is each time determined by the store owner at the time of accepting the Order for execution. As a standard, it does not exceed 5 business days from the moment the payment of the sale price of the ordered goods is credited to the store owner’s bank account, and the payment is authorized by the service mentioned in § 7 sec. 1 lit. c), or immediately after the owner of the store confirms that the Order has been accepted for execution in the case of selecting the payment on delivery.

  1. The shop owner or the Artist, as requested by the Customer, attaches a VAT invoice to the shipment being the subject of the Delivery or sends, by e-mail, to the e-mail address provided by the Customer when placing the order, a VAT invoice covering the delivered Goods. The VAT invoice is delivered by e-mail in the form of an electronic file in PDF format.

 

§ 9 Warranty

1. The shop owner or the Artist are obliged to deliver the Goods without physical and legal defects. The customer is entitled to statory warranty rights. The shop owner or the Artist are liable under the warranty if the sold Goods have physical or legal defects.

2. If the Product has a defect, the Customer may submit a declaration of price reduction or withdrawal from the sales contract, unless the owner of the store or the Artist immediately and without undue inconvenience to the Customer replaces the defective Product with one free from defects or removes the defect. This limitation does not apply if the Product has already been replaced or repaired by the owner of the store or the owner of the store has not satisfied the obligation to replace the Product with a non-defective one or remove the defect.

3.If the Customer is a Consumer, he may, instead of the removal of the defect proposed by the Shop Owner or the Artist, demand the replacement of the Product with a Product free from defects, or instead of replacing the Product, demand that the defect be removed, unless it is impossible to bring the Product into compliance with the contract in a manner chosen by the Customer or would require excessive costs compared to the way suggested by the store owner. The customer cannot withdraw from the contract if the defect is irrelevant.

4. If the Product has a defect, the Customer may request that the Product be replaced with a Product free from defects or that the defect be removed. The shop owner or the Artist is obliged to replace the defective Product with one free from defects or remove the defect within a reasonable time without undue inconvenience to the Customer. The shop owner may refuse to satisfy the customer’s request if it is impossible to bring the defective Goods into compliance with the contract in the manner chosen by the customer or would require excessive costs compared to the second possible way to bring them into compliance with the contract . If the customer is an entrepreneur, the store owner may refuse to replace the product with a product free from defects or to remove the defect also when the costs of compensating this obligation exceed the price of the sold product.

5. The Customer who exercises the rights under the warranty is obliged to deliver the defective Goods to the Store Owner or the Artist. The shipping costs are borne by the shop owner.

6. The warranty period is two years (the warranty covers physical defects that were found within two years from the date of receipt of the Goods), subject to Art. 568 § 6 of the Civil Code.

7. In the event that the owner of the store, pursuant to the provisions on the warranty, provides the Customer with Goods free from defects, he may also request the return of the defective Goods.

8. Complaints should be directed to the shop owner. Complaints may also be submitted by post as well as by e-mail to the address [email protected]

10. In the complaint, the Customer should indicate:

a) description of the defect found,

b) the requested manner of its settlement, and

c) return contact details of the Customer (name, surname, address, e-mail address).

Along with the submission of the complaint, the Customer should deliver the Goods subject to the complaint. The shop owner reserves the right to ask the customer to supplement the information contained in the complaint, if the information provided by the customer is incomplete and the complaint cannot be considered.

11. If the Customer who is a Consumer has requested replacement of the Product or removal of the defect, or submitted a declaration of price reduction, specifying the amount by which the price is to be reduced, and the store owner did not respond to this request within 14 (fourteen) days, it is considered that he considered this request justified.

12. The Customer will be notified about the method of considering the complaint by e-mail by sending a message to the Customer’s e-mail address provided in the complaint, and in the absence of such, to the Customer’s mailing address.

  1. If the Customer is a Consumer, after completing the complaint procedure, he may use out-of-court complaint and redress procedures. The use of out-of-court complaint and redress methods is voluntary and may only take place if both parties to the dispute agree to it. The above provision is for information purposes and does not mean that the shop owner agrees to participate in out-of-court complaint and redress procedures (dispute resolution).

§ 10 Personal data

1. The administrator of the personal data of the Customers of the “Sklep dla Sprawy” store is the owner of the store.

2. The Shop Owner, in the case of an Order of Goods from the “Buy Art” section, will provide the Customer’s personal data to the Artist only for the purpose and scope necessary to implement the contract concluded with the Artist.

2. In the case of purchases or registration on the store’s website, the Administrator collects the following scope of Customers’ personal data: name and surname, name, exact address of residence or registered office, e-mail address, contact telephone number, tax identification number. In the case of Registered Customers who have a Customer Account, the Shop Owner also collects the history of purchases in the Shop for the Cause, related to the Customer’s data. This history is available only to the Customer and Shop Owner and is not shared with other entities.

3. The entrusted personal data is used only for the purpose of implementing the sales contract.

4. In connection with the performance of the contract, personal data may be made available to courier companies or other intermediaries in the delivery of the purchased goods, payment system operators referred to in §6 sec. 1. lit. c) (if such a form is chosen by the Buyer).

5. Personal data are provided voluntarily, but without providing them, it is not possible to properly execute orders.

6. Personal data is not shared with other entities for marketing purposes.

7. The customer has the right to access his data, correct it, delete it and the right to demand that the processing of personal data is stopped.

  1. The user is informed that the Administrator uses cookies to provide services. The user may change the conditions for storing and handling cookies. Detailed information on the purpose of storing and accessing information using Cookies, as well as the User’s ability to specify the conditions for storing or accessing information contained in Cookies, by means of software settings installed in the User’s telecommunications end device or service configuration, can be found on the Cookies Policy page.

 

§ 11 Final Provisions

1. Agreements concluded via the “Shop for the Cause” are concluded in Polish.

2. The owner of the store honors all the rights of customers provided for in the provisions of applicable law, in particular those provided for in the provisions of the Act of 23 April 1964 Civil Code (uniform text Journal of Laws of 2014, item 121, as amended) and the Act of April 30, 2014 on consumer rights (Journal of Laws of 2014, item 827). The provisions of these Regulations exclude the Consumer’s rights under the above-mentioned acts, unless it results directly from the wording of the act and these Regulations.

3. The Regulations may be amended from time to time, and the effective date of the changes will be indicated on the Store’s website for the Case. The amended Regulations will apply to orders placed from the date of entry into force of the amendments., The amendment to the Regulations does not have any impact on orders placed before the date of entry into force of the amended Regulations and contracts concluded on the basis of such orders.

6. In matters not covered by these Regulations, the provisions of Polish law shall apply, in particular the Act of 23 April 1964 Civil Code (uniform text Journal of Laws of 2014, item 121, as amended), and in the case of Customers who are Consumers also include the provisions of the Act of 30 April 2014 on consumer rights (Journal of Laws of 2014, item 827).

7. These Regulations shall enter into force on June 20, 2021 and shall apply to contracts concluded from that date.
